These terms are an agreement between “Presskit”, “we”, “us” and the business or person who uses our services (“you”). By installing our software, having us host a site, connecting an account, or otherwise using the services, you agree to them. If you act for a business, you confirm you are entitled to bind it. Our services are for business use.
A separate written agreement or quote with you prevails over these terms where the two differ.
We provide whichever of the Software, Hosting, Analytics and Connect you have asked for. We may improve or change them over time. If we withdraw a service or a feature you rely on we will give you at least 30 days’ notice, except where a Provider’s change or a legal requirement leaves us less.
You are responsible for the Sites you run, for the people you give access to them, and for keeping your credentials safe. Tell us at once if you believe an account has been compromised. You confirm that you have the right to run each Site and to install the Software on it. If you turn on Sign-in for a Site, you decide which organisations and email domains may sign in and what each group may do there. The people you admit are yours to manage. You confirm you are entitled to let Connect read their names, email addresses, group memberships and photos for that purpose, and that your organisation’s Microsoft or Google administrator has consented where their rules require it.
We grant you a non-exclusive, non-transferable licence to install and use the Software on your Sites for as long as you are our customer and comply with these terms. You may not copy it except for backup, redistribute it, sell it, remove its notices, or reverse-engineer it beyond what the law allows. The Software is delivered and updated from presskit.live; a Site contacts us to check for and download updates (see our Privacy Policy). We may stop supporting an old version once a newer one has been available for 90 days.
If we host a Site:
Your authority. When you connect an account you confirm that you own or administer it and are entitled to let us read its figures, and that doing so does not breach the Provider’s terms or anyone else’s rights. If you connect a client’s account, you confirm the client has agreed.
What we do with it. We read only what the permissions you grant allow, we store only what the Privacy Policy lists, and we use it only to provide Analytics to you: your screens, your weekly email, and the support you ask for. We do not sell it, use it for advertising, combine it with another customer’s data, or use it to train any model. Each customer’s data is kept separate.
Tokens. Connect holds your refresh token encrypted and never passes it on. Analytics receives only short-lived access tokens.
Disconnecting. You may disconnect any account at any time from Presskit SEO’s settings or from the Provider’s own settings. We stop collecting that day and delete its data as the Privacy Policy describes.
The Providers decide what exists. Figures come from the Providers’ interfaces, which they change, delay, revise and withdraw. We show what they give us. Figures may differ from the Provider’s own screens, a day may arrive late or be revised, and some figures are available only once a Provider accepts an application from us. None of that is a fault in the services.
What the figures are for. Analytics describes how your content performed. It is information to help you decide, not advice, and decisions you make on it are yours.
What we do. When a person signs in to your Site through Connect, we pass their name, email address, groups and photo from the Provider to your Site once, and keep none of them. We keep a record that a sign-in happened, with no one’s identity in it, for thirty days, so that a failed sign-in can be explained. What your Site keeps about the person is set out in the Privacy Policy (§ 4.6) and is yours, under your own privacy policy.
The Providers decide. A sign-in depends on the Provider: if the Provider refuses, changes what it tells us, or your directory changes, the sign-in may fail or the person’s role on your Site may change at their next sign-in. That is not a fault in the services. Keep at least one administrator who can sign in with a password.
Your people. People who sign in to your Site are subject to your Site’s own rules, and you are responsible for what they do there.
By connecting a YouTube channel, or using any feature of the services that reads from YouTube, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms). Presskit uses YouTube API Services. Google’s handling of your data is described in the Google Privacy Policy (http://www.google.com/policies/privacy), and you can revoke our access to your Google data at any time on the Google security settings page (https://security.google.com/settings/security/permissions).
Our use of information from Google APIs follows the Google API Services User Data Policy (https://developers.google.com/terms/api-services-user-data-policy#additional_requirements_for_specific_api_scopes), including its Limited Use requirements.
Your use of Facebook, Instagram and TikTok remains subject to the Meta Terms of Service (https://www.facebook.com/terms), the Instagram Terms of Use (https://help.instagram.com/581066165581870) and the TikTok Terms of Service (https://www.tiktok.com/legal/terms-of-service). Where we read your data from those platforms we do so on your behalf and at your direction, under their platform terms for technology providers.
Signing in with a Microsoft account is subject to Microsoft’s terms for your organisation’s Microsoft 365 or Entra service and to the Microsoft Privacy Statement (https://privacy.microsoft.com/privacystatement). Signing in with a Google account is subject to the Google Terms of Service (https://policies.google.com/terms) and the Google Privacy Policy linked above.
You will not use the services to break the law, infringe anyone’s rights, send unsolicited bulk messages, attack or probe any system, connect an account you are not entitled to connect, admit to a Site through Sign-in anyone you are not entitled to admit, or circumvent a Provider’s terms or limits. We may suspend a service that is being used that way, and will tell you why.
Fees, payment terms and what happens on late payment are as set out in your quote or written agreement with us. If none exists for a service, that service is provided without charge and may be withdrawn on 30 days’ notice. Fees exclude GST unless stated.
We run the services with care and keep them available as far as we reasonably can, but we do not promise uninterrupted availability unless a written agreement with you says so. Support is by email at [email protected] during Australian business hours. Scheduled collection, reports and emails may be delayed by a Provider’s outage, by maintenance, or by a failure at a service provider we rely on.
The Software, the services, our documentation and our brand are ours and stay ours. Your content, your Sites and your figures are yours and stay yours; you give us only the licence we need to host, process and show them to you. If you give us feedback or suggestions we may use them without obligation.
Our Privacy Policy describes what we collect and why, and forms part of these terms. For your visitors’ data, your Connected Accounts’ data and the people you let sign in to your Sites, we act as your service provider: we process it on your instructions and use it for nothing else. Each side will keep the other’s confidential information confidential and use it only for this agreement, except where the law requires disclosure.
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot be excluded. Where the law allows us to limit our liability for a failure of such a guarantee, it is limited, at our choice, to supplying the service again or paying the cost of having it supplied again.
Beyond that, and to the extent the law allows: the services are provided as they are; we do not warrant that they will be error-free or meet a particular purpose; we are not liable for loss of profit, revenue, data or goodwill, or for indirect or consequential loss; and our total liability to you under or in connection with these terms in any 12-month period is limited to the fees you paid us in that period, or AUD $1,000 if greater. These limits do not apply to liability that cannot be limited by law, or to a party’s fraud or wilful misconduct.
You are responsible for your Sites’ content and for how you use the figures, and you will cover us against claims arising from them.
These terms apply for as long as you use the services. Either side may end them on 30 days’ written notice. We may end or suspend them at once if you breach them materially and do not fix the breach within 14 days of notice, or if the law or a Provider requires it.
When they end: your licence to the Software ends; we revoke and erase every Connected Account’s token; Sign-in to your Sites through Connect stops, and what your Sites hold about their people stays yours; on request within 30 days we give you an export of your hosted Site and your collected figures in a usual format; and after that we delete your data as the Privacy Policy describes. Clauses that by their nature continue (12, 13, 14 and 17) do so.
We may change these terms. We will post the new version here with its date, and give you at least 30 days’ notice by email of any change that materially affects you. Continuing to use the services after that date is acceptance. If you do not accept a change you may end the agreement before it takes effect.
These terms are governed by the laws of Victoria, Australia, and the courts there have jurisdiction. If a clause is unenforceable the rest stands. Neither side is liable for delay caused by events outside its reasonable control. You may not assign these terms without our consent; we may assign them to a successor of our business with notice to you. Notices are given by email to the addresses each side last gave the other. These terms, the Privacy Policy and any written agreement between us are the whole agreement.
